Guide · Working time
Working time recording in taxis: an obligation that can be met on the side.
Customs checks, MiLoG record-keeping obligation, labour court — your drivers' working time must be documented. With starksoft, the evidence is created automatically with the shift: start, end, breaks — without a single shift sheet.

What the law requires
In the taxi and private hire trade, several obligations come together — and the sector is a particular focus of inspections.
- § 17 MiLoG (Minimum Wage Act): for mini-jobbers and other forms of employment, the start, end and duration of daily working time must be recorded no later than seven days after the work is performed and retained for two years.
- Case law: in 2022, the Federal Labour Court (BAG) clarified that employers must systematically record their employees' working time.
- Working Hours Act (ArbZG): maximum working hours, rest periods and breaks naturally also apply to driving staff.
Automatic instead of paper: how it works with starksoft
| Moment | What is documented |
|---|---|
| Shift start | The driver signs in at the taximeter, the driver app detects the shift — the start of working time is set and assigned to the vehicle. |
| During the shift | Breaks are recorded in the app and separated from driving and standby time. |
| Shift end | End of working time, total duration and total breaks are fixed — consistent with the journey and fiscal data of the same shift. |
| In the office | Working times per driver and period in the back end, export for payroll and inspections — retained audit-proof. |
The decisive advantage: working time, shift and taximeter data come from one source — they cannot contradict each other.
Frequently asked questions about working time recording
Do I have to record my taxi drivers' working time?
Yes — § 17 MiLoG requires records within seven days, and in 2022 the BAG established the general obligation to record working time systematically.
Is a paper shift sheet enough?
Formally possible, practically risky: error-prone, easily lost, hard to verify. Digital recording with the shift is more robust.
Does waiting time count as working time?
Waiting time while ready for duty generally does — genuine breaks do not. That is why you need recording that cleanly separates the two.
How does it work with starksoft?
Working time is recorded automatically with the shift in the driver app; the office exports per driver for payroll and inspections.
What are the risks without recording?
Fines, back payments of wages and social security contributions, lack of evidence before the labour court.
The next customs check can come.
